Release Form (Terms and Conditions):
This project is funded by a research grant from Kansas State University (K-State). All participants must agree to the Release Form Terms and Conditions prior to participating in the K-State Virtual Flute Choir project. This Release Form constitutes a contract between the participant and K-State. In these Terms and Conditions and the check boxes above, “I” means any person, entity or other participant completing the video submission form, provided that if such participant is under 18 years of age, “I” also includes such person's parent or guardian.
I hereby give Kansas State University and its Department of Music (K-State) the right and permission to publish, without charge, photographs and/or video footage, in whole or in part, whether in digital format or otherwise, submitted by me for the K-State Virtual Flute Choir project, along with my name/city/state/country and any other appropriate captions utilizing either audio or visual format. These photographs and videos and any accompanying descriptive audio or visual caption, including names of those appearing in same, may be used in whole or in part, and may be used in publications and in audio-visual presentations, promotional literature and materials, advertising, website promotions, or in other similar ways for the K-State Virtual Flute Choir project. I represent that I am fully aware that I will have no claim to any of these materials or any other resulting K-State Virtual Flute Choir project materials by copyright, invention or any other statutory protection mechanism and that all such materials will be owned by K-State as the original creative author. I represent that, to the best of my knowledge, my video submission does not infringe, misappropriate or otherwise violate any third party copyright, intellectual property rights, or other rights.
I agree to indemnify and hold K-State harmless from any damage, loss or injury that I may incur as a result of my participation in the K-State Virtual Flute Choir project, unless such is due to the negligent acts or omissions of K-State. It is understood that K-State can only assume responsibility for liability that may arise that is a sole result of the negligent acts or omissions of K-State and its officers, employees and agents, acting within their official capacities, subject to the provisions of the Kansas Tort Claims Act (K.S.A. 75-6101 et seq).
By submitting my video, I understand that I am giving K-State permission to use the photos and/or video footage I submit solely for the K-State Virtual Flute Choir project. In addition, I hereby agree to waive any right to financial reimbursement for the reproduction of such photos and/or video footage as used by K-State for the stated purpose, now or in the future and I acknowledge and agree that will not be entitled to any copyright or inventive rights in same.
K-State has and will continue to respect the privacy of all participants by not distributing personally identifiable information to any third party for any reason except as described in these Terms and Conditions for the purposes described herein.
